This is a typical example of a misunderstanding. The truck driver did not see the car - let alone take note of its intention change the lane.
Since the truck did not start immediately, the car driver assumed that he was being let in.
Now it is questionable whether this is a situation where one should have expected vehicles to turn in. This cannot be stated by that little snippet.
Therefore, I would be very cautious about calling the car driver an idiot, especially since I assume that he did not want to enter the gap by all costs, but that he really assumed that he was let in.
And even if the car driver cannot necessarily be described as stupid, he might undoubtedly bear the majority of the blame for the accident.
Some dumb bitch almost did this to me today with her shit 1999 crossover. The repairs on my vehicle would have been super expensive and I would have sued the fuck out of her due to her extreme negligence in her merging etiquette alone.
In germany it is called "Haftpflichtversicherung" which means the insurance MUST pay the costs for the trucks damage. Only if they can proof that you were doing it on purpose they dont need to pay for it.
